Malpractice after treatment in another EU country

An assessment of malpractice is made in accordance with the law of the state of treatment. This also applies to any court action and to amounts of liability.

If you suffer damage to your health as a result of medical treatment in another EU country and fear that for instance the doctor or dentist has been guilty of malpractice, you can only take action against him/her in accordance with the law of that country. In this case, the court procedures, the rules on the burden of proof, the preconditions for compensation, the liability amounts, etc., are in line solely with the law of the state of treatment.

The National Contact Point of the state of treatment will provide you with information on the rights and possibilities which you have in a Member State in the event of malpractice.
